These General Terms of Sale, applicable since 9 December 2010, apply between FORTWENGER, registered with Colmar Trade and Companies registry under the number B917 121 444, with registered office at 144, route de Strasbourg à 67140 Gertwiller (European VAT no.: FR 84 917 121 444), on the one hand, and any natural person wishing to make a purchase via the websitehttp://www.fortwenger.fr, on the other.

1. Orders

Acceptance of these general terms of sale Any order placed with Pains d'Epices Fortwenger using the form provided on the site implies the full and unreserved acceptance of these terms of sale, which alone shall apply to the contract thus entered into.

Availability
Orders will be fulfilled while stocks last and within the delivery times defined. Special offers apply while stocks last.

Order procedure
Orders are only taken into account once the customer has completed the online form. They only become effective when the bank payment centres concerned and Pains d'Epices Fortwenger have given their agreement. Pains d'Epices Fortwenger will confirm their acceptance of the order to the user by e-mail. If said centres refuse payment, Pains d'Epices Fortwenger reserve the right to cancel the order and to inform the customer within 48 working hours of the latter entering the order on the internet.

Customers' details
To be able to process your orders, we ask you to provide your surname, first name, address (including the door code, if there is one), telephone number, the date of the order, and if you already have one, your customer reference to facilitate our job. We cannot handle incomplete requests.In accordance with French data protection law, we inform you the collection of the information concerned by the mandatory fields in "Identification" and "Contact" is necessary to the processing of the enquiry.

The information collected is purely for the use of Pains d'Epices Fortwenger. It enables us to process your enquiry, to offer you personalised services and inform you about our products and services. It is used for customer loyalty building, administration and statistical analysis purposes.
In accordance with French data protection law (Article 34 of Law no. 78-17 of 6 January 1978), Pains d'Epices Fortwenger reminds you that you have a right of access, rectification and deletion of your data.

In accordance with French data protection law, we undertake not to pass on your personal data, which will be processed and stored under conditions guaranteeing the security of the information. You also have a right of access, rectification and opposition to the use of your personal data.

Refunds and replacements
Pains d'Epices Fortwenger takes great care in preparing orders. However, it is up to the recipient to check the number and condition of the products at the time of receiving them.

If the delivery is incorrect or non-compliant, Pains d'Epices Fortwenger must be informed in writing within 24 hours of delivery. Customers undertake to comply strictly with the conditions of storage for the products and the Use By dates marked on the packaging. No reservations may be made by customers on criteria concerning the taste, freshness or appearance of the products.

If we are lacking a product, we will replace it with a similar product or one of higher value so as to avoid delaying the delivery (unless specified otherwise by the customer).

Cooling-off period
the customer has a statutory right to a 14-day cooling-off period as of the date of receiving the goods with no need to specify the reason or pay any penalties being due. The customer will be refunded in full as quickly as possible and at the latest 14 days after receipt of the return package.

Returned items must be new, completely intact, unused and in their completely intact original box. The cost of returning the goods is paid by the customer. To return goods during the cooling-off period, send us an e-mail at info@fortwenger.fr

If the items returned have visibly been used or damaged by the customer and such use or damage renders them unfit for sale, the return will be refused and the goods will be sent back to the customer. In this case, no refund will be given and, where applicable, only the warranty on the goods will operate.

Fortwenger.fr also reserves the right to directly cancel any order where it considers that there are one or more risk factors relating to the fraudulent use of a bank card.

The cooling-off period does not apply to fresh produce.

2.Obligations

Obligations of Pains d'Epices Fortwenger
Pains d'Epices Fortwenger undertakes, when it accepts an order, to sell and ship the goods ordered by the customer within an average of 7 working days of receiving the order.

Customer's obligations

The customer undertakes to complete the order form accurately. The customer shall refrain from re-selling the goods, as the order is intended for the customer's personal use only or for that of the personal to whom it is shipped.

3.Specific provisions

Terms of payment
The prices of the goods and shipping costs are billed inclusive of tax. Prices are guaranteed while stocks last and subject to any changes in the VAT rate. Any change in the VAT rate will be passed on to the sale prices immediately. The total price stated in the order confirmation given by Pains d'Epices Fortwenger is the final price. Prices are quoted in Euros.

Products are payable cash on the day of the effective order. Payment is made online VISA or MASTERCARD bank card using the secure payment system. The card will be debited when the order is accepted.

NB: A detailed invoice will be enclosed in the package. VAT will be detailed so that public bodies, companies and self-employed people can deduct it.

Delivery time and place

The order will be only be shipped once full payment has been received. Orders will be delivered by post within approximately 7 days of the order being confirmed. This delivery time is provided for information only. No compensation may be sought from Pains d'Epices Fortwenger in the event of delayed delivery.

Delivery will be made to the address provided by the customer in the order form. The customer undertakes to receive the goods ordered on the date agreed.

If the customer is absent when the parcel is delivered, Pains d'Epices Fortwenger may not be held liable for any damage incurred to the goods or for non-collection by the recipient.
